Terms & Conditions

Terms and Conditions

By enrolling your child at Dare to Dream Performing Arts, you agree to these

terms and conditions. These include the terms set out on this page, our

Privacy Policy, Cookies Policy, and any other policies or procedures we notify

you of from time to time (together referred to as the “Terms”).

Your acceptance of the Terms forms an ongoing agreement between you

and Dare to Dream Performing Arts (“Agreement”).

This Agreement is made between the parent or legal guardian (“parent”,

you” or “your”) of each enrolled student (“student”) and Dare to Dream

Performing Arts (“we”, “us” or “our”), a sole trader registered in the United

Kingdom trading as Dare to Dream Performing Arts.

The Agreement remains valid for the entire period during which the student is

enrolled in any Dare to Dream Performing Arts activity and continues until

written notice is given in accordance with these Terms.

Introduction

Before enrolling your child with Dare to Dream Performing Arts, it is important

that all parties understand and agree to how our relationship will operate.

These terms and conditions are intended to explain how we work and how we

will work with you.

We may amend these terms from time to time. When changes are made, we

will notify you by writing to you, emailing you, or by updating this webpage.

For the avoidance of doubt, updating this webpage alone (without additional

written or email notification) will constitute sufficient notice of any changes to

the terms.

If you do not agree with any changes to the terms, your sole remedy is to give

notice to withdraw your child from Dare to Dream Performing Arts classes,

which will bring our agreement to an end. If a change to the terms is

materially detrimental to you, you may have limited rights to cancel without

providing the usual notice period; where this applies, we will inform you.

Your child’s continued attendance at classes, or your continued use of or

interaction with any of our services after the terms have been updated, will be

taken as acceptance of the revised terms.

These terms supersede and replace all previous agreements between the

parties, whether written or oral, and govern our contractual relationship going

forward. Any statements, promises, assurances, guarantees, or offers made

by any member of the Dare to Dream Performing Arts team, or by any

affiliates, agents, or franchisees, which are not expressly set out in this

agreement or any attached schedule, do not form part of this contract and

are not binding on either party.

A “course” means a programme of classes in dance, drama and singing,

delivered during a term. Classes take place once per week for the number of

hours specified at the time of booking.

The “Principal” refers to the Principal of Dare to Dream Performing Arts.

A “term” means a standard academic term during which courses are run by

Dare to Dream Performing Arts.

“Term dates” refer solely to the dates of the relevant Dare to Dream

Performing Arts term and do not correspond with, or relate to, local authority

school term dates in the area where the school operates.

We have made every effort to ensure these terms are clear and easy to

understand. If you have any questions after reading them, please contact us

or speak to our Dare to Dream Performing Arts Principal, who will be happy to

help.

Enrolling a new student in a Dare to Dream Performing Arts’ activity

To apply for a place in a Dare to Dream Performing Arts’ activity, a parent

must agree to the terms and conditions and register for classes using the

external ‘Class4Kids website’ either online or by phone.

The termly fee and any joining fee for the selected course will be clearly

stated in ‘Class4Kids’, our website and course marketing materials.

If Dare to Dream Performing Arts is unable to offer the student a place due to

limited capacity, the parent may choose to have the student added to a

waiting list. No payment is required to join the waiting list, and no fee will be

taken if a place is not available. In exceptional cases, such as when two

parents apply for the same place at nearly the same time, a payment may be

taken from the second applicant but will be refunded promptly if the place is

unavailable.

Free Trials

A free one-week trial is available at Dare to Dream Performing Arts for new

customers only. If a student has previously attended a free trial of any Dare to

Dream Performing Arts class at any time, they may not be eligible for another

free trial.

If a student books a free trial but does not attend, Dare to Dream Performing

Arts may choose not to offer a rescheduled trial session.

All free trials must be booked in advance through the external booking system

on our website. The trial allows the student to attend Dare to Dream

Performing Arts classes for one week only to experience the programme free

of charge. The trial period cannot be extended. Any exceptional

circumstances must be accepted by the Principal and are at their discretion.

A parent or guardian must attend the first session with the student and arrive

10 minutes before the scheduled start time of the class. Parents or guardians

should also be prepared to stay for the first 20 minutes of the class to speak

with the Principal about the school and how their child is getting on in their

trial.

Dare to Dream Performing Arts reserves the right to cancel or refuse a free

trial to any student at any time and for any reason.

If the free trial is successful for both parties, the parent or guardian will receive

an email inviting them to book on and continue for the remainder of the term.

This email will include instructions and a link to make payment. If the offer to

continue is not accepted before the next class commences, we will assume

that the place is no longer required and may offer it to another student.

If a parent or guardian chooses to book a full term for a new student without

first attending the free trial, the trial period does not apply and the parent or

guardian will be committed to the full term.

Payments

Dare to Dream Performing Arts cannot admit students or reserve places

without payment, (apart from the one - off free trial booking that each child is

entitled to). All payments must be made by debit or credit card through the

external booking system linked on our website. 'Payment Secures Booking' is

applied to all bookings and parents and carers will not be able to complete

their booking without entering their card details. Non-payment may result in

suspension of attendance.

Any other methods of payment are accepted at the Principal’s discretion.

Fees are payable up to 72hrs in advance of the current term commencing

(termly or as specified).

If a parent or guardian enrols a student following a free trial, they will be

charged on a pro-rata basis for the remaining weeks of the term. An

up-to-date record of your payment schedule will be available in your online

account.

Late Pick up Fees

Students who require collection after a session must be picked up within 5

minutes of the session ending. Late collection may incur a charge of £10 per

every 15 minutes. If a student is collected late on three or more occasions

during a term, Dare to Dream Performing Arts reserve the right to cancel the

student’s place at its discretion, with no refund provided.

Pick up expectations

Any changes to pickup arrangements must be communicated in writing to

Dare to Dream Performing Arts as soon as possible.

When a parent or guardian first enrols their child in a Dare to Dream

Performing Arts activity, they must provide the names of all individuals

authorised and trusted to collect their child.

These individuals will be recorded on the student's emergency contact list

and/or in explicit communication with the Dare to Dream Performing Arts

Principal. Anyone on a student’s emergency contact list must also be a

trusted adult.

Cancellation Policy

To cancel your child’s place, you must provide written notice to Alicia O’Neill,

Principal of Dare to Dream Performing Arts, no later than the final day of the

current term.

When a session is cancelled by Dare to Dream Performing Arts, we will provide

as much notice as possible via email, text, phone, social media, or updates to

our website. Parents are responsible for checking these updates. A cancelled

class will be rescheduled and added on to the end or beginning of the current

or future term, therefore no refund will be given as the service is still being

offered. In the very unlikely event that the class cannot be rescheduled by

Dare to Dream Performing Arts, a full refund for this session only, will be given.

Refunds

Refunds will only be issued where Sessions are cancelled by Dare to Dream

Performing Arts and unable to be rescheduled. If a workshop is cancelled by

us, families will be notified as soon as a final decision has been made, and a

full refund will be issued automatically to the original payment method. No

additional compensation will be provided.

No refunds will be given for missed sessions, absence due to illness or holiday,

withdrawal without appropriate notice. If a student is unable to attend a

session due to holiday, weather, transport issues, a parent or student decision,

or any other reason, the parent remains liable for the full session fee.

In exceptional circumstances, a refund or credit may be considered at the

sole discretion of Dare to Dream Performing Arts.

Dare to Dream Performing Arts’ Fee Account Credit

From time to time, Dare to Dream Performing Arts may offer credit that can be

used toward future Dare to Dream classes or workshops. Any credit applied to

a Dare to Dream Performing Arts fee account is non-refundable and

non-transferable, and may only be used to pay for class fees or workshops.

Workshop Cancellations

All Dare to Dream Performing Arts holiday workshops (camps) are subject to

minimum participant numbers and overall programme viability. To run a

workshop safely and to the standard we expect — including appropriate

staffing ratios, balanced age groups, and a fully structured programme — a

minimum number of bookings is required. In some cases, despite bookings

being made, it may not be possible to meet these requirements.

In such circumstances, Dare to Dream Performing Arts reserves the right to

cancel a workshop (camp) prior to its scheduled start date. If a workshop is

cancelled by us, families will be notified as soon as a final decision has been

made, and a full refund will be issued automatically to the original payment

method. No additional compensation will be provided.

Cancellations of this nature are rare and will only occur where necessary to

maintain the quality, safety, and overall experience of the children attending.

Courses

Once enrolled on a course, parents will be informed of the term dates for the

following term by the end of the current term. This information may be

provided in writing, by email, verbally, or published on our website.

If a scheduled course session falls on a bank holiday, a replacement class will

be arranged and added to the end of the current term timetable or to the

following term.

Health and injuries

Students participate at their own risk and are obliged to inform Dare to Dream

Performing Arts and its staff of any existing injuries or medical condition. Upon

booking onto a Dare to Dream Performing Arts course any known medical

conditions must be stated and any changes to such information must be

notified to Dare to Dream Performing Arts immediately in writing.

If you are unsure whether a student should participate in any activity please

consult the student’s GP before enrolling the student in a Dare to Dream

Performing Arts’ activity.

By agreeing to these terms, you are consenting to first aid treatment being

given if necessary.

By agreeing to these terms you authorise Dare to Dream Performing Arts’ staff

to sign emergency consent forms if required by hospital authorities.

Any medication left on premises used by Dare to Dream Performing Arts must

be clearly labelled.

If you have indicated that the student requires medication and they attend a

class or workshop without the medication they may be denied entry due to a

health and safety risk. Should this occur, you will still be liable to pay for the

class or workshop.

Students must wear suitable footwear and clothing at all times, including

Dare to Dream Performing Arts’ uniform for all courses and workshops.

If a student is unwell or has an accident requiring emergency treatment, the

parent will be contacted via the emergency contact details provided on the

application form. Parents or guardians are solely responsible for ensuring that

their emergency contact details are kept up to date.

All children must be toilet trained i.e., are able to go to the toilet independently - no use of nappies or potties are permitted at Dare to Dream Performing Arts.

Personal property

Students are responsible for taking care of their own belongings. Dare to

Dream Performing Arts accepts no liability for lost or damaged items,

including damage caused by another student or by any Dare to Dream

Performing Arts employee, agent, affiliate, or franchisee.

You acknowledge that the maximum total liability of Dare to Dream

Performing Arts to a student or parent under these terms shall not exceed the

activity fee paid for the relevant session (for courses, this means the fee for

one class).

Liability of Dare to Dream Performing Arts, its employees, agents, and

franchisees is limited to class time and applies only in cases of gross

negligence.

Photo Permission

By agreeing to these Terms and Conditions you confirm your understanding

that, if you provide explicit informed consent to photo permissions via

Class4Kids, Dare to Dream Performing Arts may use your child’s photos as

outlined in our Photography and Filming Policy.

Our Photography and Filming Policy outlines the requirement for permission

to be obtained before sharing images of other children. Dare to Dream

Performing Arts will not be liable for adults associated with Dare to Dream

Performing Arts sharing images of children other than their own without

permission.

General

Dare to Dream Performing Arts may, at its sole discretion, refuse entry to any

student for a session or activity if their behaviour is deemed unacceptable, or

for any other reason. No refund will be provided, and you will remain liable for

the full cost of the activity.

Dare to Dream Performing Arts reserves the right to make changes to the

timetable or teaching staff in the event of illness or circumstances beyond

our control.

Occasionally, it may be necessary to change the time or venue of a session.

Such changes will only occur when absolutely necessary, and we will make

every effort to keep class times and locations as close as possible to the

original schedule.

Dare to Dream Performing Arts reserves the right to switch to online teaching

for weekly classes or courses for up to 21 consecutive days in response to

government restrictions, COVID-19 regulations, staff or student self-isolation,

or venue unavailability. By agreeing to these terms and conditions, you are

aware that the online teaching classes will be recorded for safeguarding

purposes unless otherwise specified. During the first 21 days, fees and

cancellation policies remain unchanged. If online teaching continues beyond

21 consecutive days, a 33% discount will apply for subsequent online classes,

and parents will have the option to cancel classes immediately.

Termly fees are reviewed annually on 1st January. Any increase up to the

higher of the Retail Price Index (RPI) based on the November figure of the

previous year or 10% will not be considered a detrimental change to these

terms. Revised termly fees will be communicated by 31st December each

year.

Dare to Dream Performing Arts may also increase termly fees in April, July, or

October by no more than the RPI for the preceding two months if RPI exceeds

5%, to mitigate the impact of inflation and maintain the sustainability of

classes.

These terms, together with information on our website and social media

platforms, constitute the entire agreement between the parties, superseding

all prior agreements, promises, or representations, whether written or oral.

If any part of this agreement is found to be unlawful or unenforceable, that

part shall be severed without affecting the remainder of the agreement.

Failure by Dare to Dream Performing Arts to enforce any provision of this

agreement does not prevent future enforcement of the same provision.

This agreement is governed by and constructed in accordance with the laws

of England and Wales, and any disputes or claims shall fall within the

jurisdiction of the English courts.
